Senator Weta’s lawyers have this afternoon moved to withdraw their application challenging Dr Eseli’s move to the change the top leadership in Ford Kenya from the Political Parties Disputes Tribunal.
In an application that has been filed at the same Tribunal and served to Bryan Khaemba appearing for Ford Kenya SG Dr Eseli Simiyu, Senator Wetangula through Lumalla, Achieng & Kavere Advocates, said he wants to pursue internal mechanisms to resolve the dispute.
Curiously, in reaching the decision, the same lawyers purport to enter consent for and on behalf of Dr Eseli and other respondents in what is designed to help them achieve what the Tribunal did not grant them yesterday.
When they appeared before before the Political Parties Disputes Tribunal, yesterday, they sought:
(1) That their case is certified as urgent.
(2) Conservatory orders restraining the Registrar of Political Parties from effecting any changes as submitted Dr Eseli.
(3) That an order is issued against the ORPP from recognising Hon Wafula Wamunyinyi as Interim Party Leader.
(4) A host of prayers whose full import would invalidate the Gazette notice.
However, the Tribunal only granted one prayer, certifying the case as urgent and bringing it forward to June 12, 2020 from an earlier mention date of June 16, 2020.
The Tribunal further asked the applicants to serve all parties in the case.
It’s not clear how then the applicant’s lawyers want to extract orders the Tribunal didn’t grant them.
Dr. Eseli while speaking to Wakajuaness on phone, confirmed knowledge of the notice but insisted that the Senator has not withdrawn the case, but only filed a notice to withdraw.
The Eseli faction has roped in Lawyer Otiende Omolo who will be leading three other senior lawyers in the case.
