This is Why the High Court Nullified Cyprian Awiti’s Win as Homabay Governor

The High Court has today Tuesday 20, February 2018 nullified the election of Homabay Governor Cyprian Awiti (pictured, file), in a petition that was filed by immediate former Kasipul MP Oyugi Magwanga.

This is after Magwanga’s legal team led by lawyer Charles Kanjama, managed to convince the court that there were massive irregularities that undermined the credibility of the August 8, 2017 election in Homabay County. 

In his ruling a few minutes ago, Justice Joseph Karanja ordered a fresh election citing the irregularities that Magwanga’s team had submitted and proved in the court.

Magwanga, who came second after Awiti in the disputed election had filed the petition at Homa Bay High Court last year.

The High Court ordered a voter recount and scrutiny for the gubernatorial race.

Though Mr Awiti had applied for the dismissal of a voter recount, Justice Karanja ordered a voter recount.

An audit of the results on forms 37A, B and C, as well as KIEMS kits used by the electoral agency was carried out as ordered by the court.

With the results nullified, Homabay County will have to go back to the ballot as required by the constitution.
