Machakos gubernatorial aspirant Ms Wavinya Ndeti (R) with NASA co-Principal Kalonzo Musyoka flanked by jubilous supporters today Wednesday after court allowed her to vie for the seat on a Wiper ticket.
Machakos Governor Alfred Mutua will now have sleepless nights after a High Court overturned a decision by Independent Electoral and Boundaries Commission (IEBC) Dispute Resolution Committee to block Wavinya Ndeti from contesting for Machakos gubernatorial seat.
Justice George Odunga, in his ruling today, noted that the Political Parties Disputes Tribunal decided she is a bonafide member of of the party led by NASA principal Kalonzo Musyoka and therefore the Interim Electoral and Bounderies Commission (IEBC) committee had no power to nullify the tribunal’s decision.
The committee had blocked Ms Wavinya Ndeti from vying for the seat on basis that she flawed political parties act by allegedly being a member of two political parties, a move that bars one from contesting.
Wavinya insisted that she had followed the law, and ensured she was in Wiper Party’s list before the deadline set by IEBC, which was the talking point at the High Court.
The commission’s lawywer Paul Nyamondi, told Justice Odunga that the aspirant based her membership to Wiper through a coalition agreement with her Chama cha Uzalendo (CCU) in April 24, 2017.
An seemingly joyous Ndeti celebrated along the streets while flanked with her supporters and running mate Peter Mathuki and Wiper leader and NASA’s co-princioal Kalonzo Musyoka after Judge George Odunga ruled she is an eligible Wiper party candidate.
Ms Ndeti will now contest for the Machakos gubernatorial seat against Governor Alfred Mutua of Maendeleo Chap Chap in the August 8 general election in what analysts say will be a hotly contested race.
